Sell Inherited
Sell an Inherited Commercial Property in New Jersey
How heirs sell a commercial building in NJ: authority to sell, pricing and AcreX’s published fee.
When a parent or relative leaves you a warehouse, storefront, office or mixed-use building in northern New Jersey, the sale involves both estate paperwork and a normal commercial listing. This page outlines the sequence. It is general information, not estate or tax advice.

Typical sequence
1. Talk to the estate or probate attorney. Confirm who has authority to sell and whether court approval is needed (NJ Courts — estates and probate).
2. Gather the deed, leases, expenses, tax bills and any environmental reports.
3. Get a written opinion of value so co-heirs can agree on a list price (What is my commercial property worth?).
4. Sign a written listing agreement with a New Jersey-licensed broker (N.J.S.A. 25:1-16).
5. Market, negotiate and close. Plan for the realty transfer fee (realty transfer fee), bulk-sale notice (NJ bulk sale FAQ) and, for nonresident sellers, estimated withholding (nonresident seller withholding).
Issues that often slow inherited sales
Multiple heirs who have not agreed on price or timing
Missing leases or expense records
A building that has been vacant or lightly maintained
Industrial or former gas-station sites that need environmental review

Questions owners ask
Can I sell an inherited commercial building in NJ?
Usually yes, once the estate or trust has authority to sell. Your estate attorney confirms who can sign and whether probate or letters testamentary are required.
Do I need probate before listing?
Often for individually owned property. Property titled in a trust or LLC may sell under the trust or operating agreement without probate. Confirm with the estate attorney before you list.
What taxes apply when heirs sell?
Federal and New Jersey tax rules for estates and capital gains can apply, and sellers still face the realty transfer fee and often a bulk-sale notice. Nonresident heirs may have estimated income tax withheld at closing. This is not tax advice — use your CPA and attorney.
How is an inherited building priced?
The same way as any commercial sale: income, comparable sales and condition. Multiple heirs often want a written opinion of value everyone can see before listing.
What does AcreX charge to sell an inherited building?
5% up to $5M, 4% on $5M–$10M, 3% above $10M, $10,000 minimum. In New Jersey commissions are negotiable.
