10 questions to ask in the interview

  1. What have you sold or leased in my town or county in the last two years, of my property type?

  2. What was your role in each deal: owner’s broker, buyer’s or tenant’s broker, or co-broker?

  3. How would you price my property, and which comparables support it?

  4. Who are the likely buyers or tenants, and how will you reach them?

  5. Will you list on the commercial listing services, and will you co-broker with other firms?

  6. Who will work on my property day to day?

  7. How often will you report, and what will the reports show?

  8. What is your fee, when is it earned, and who pays the other side’s broker?

  9. How long is the term, and how can either of us end it?

  10. Can I speak with two owners you represented recently?

What to get in writing

  • Fee and when it is earned. New Jersey requires a written agreement for a broker to collect a commission (N.J.S.A. 25:1-16).

  • Term, exclusivity and how to cancel.

  • Any protection period after the agreement ends, and the list of prospects it covers.

  • The marketing plan and budget, if the broker promised one.

How can I check a broker’s licence in New Jersey?

Use the NJ Real Estate Commission’s online licensee search, which lists active and inactive licensees and their status.

Do I have to sign an exclusive agreement?

Many owners do, because exclusivity is how a broker commits time and money to marketing. Negotiate the term, the fee and how to end it. In New Jersey a commission agreement must be in writing to be enforceable (N.J.S.A. 25:1-16).
