Sell Commercial Property in a New Jersey Divorce

How jointly owned commercial property is listed and sold during a NJ divorce — and what AcreX charges.

When spouses or partners jointly own a commercial building in northern New Jersey, a sale is often part of dividing assets. AcreX can list and market the property once counsel confirms who may sign. This page is general information, not family-law advice.

Before you list

  • Ask both divorce attorneys who must sign the listing agreement and the deed.

  • Decide whether proceeds go to escrow pending settlement.

  • Gather leases, expenses and loan statements so both sides see the same numbers.

  • Get a written opinion of value (What is my commercial property worth?) before arguing over list price.

How the brokerage piece works

Once authority is clear, the sale follows the normal commercial process: written listing (N.J.S.A. 25:1-16), marketing, contract, due diligence and NJ seller filings. See How to sell commercial property in NJ for the full steps and costs.

What AcreX charges

AcreX sale fee: 5% of the price up to $5M, 4% on the part from $5M to $10M and 3% above $10M; $10,000 minimum. Split 50/50 with the buyer’s broker. In New Jersey commissions are negotiable. Full schedule: AcreX fees and commission calculator.

  • No upfront fees.

  • Free written opinion of value or rent within 5 business days. It is a broker’s opinion, not an appraisal.

  • Reply within 2 business hours.

  • Jonathan Libock, principal broker, leads every listing.

  • Weekly owner report.

  • 6-month listing agreement; cancel on 30 days’ notice after day 90.

Questions owners ask

Can we sell a commercial building during a divorce in NJ?

Often yes, if both owners who must sign agree, or if a court order authorizes the sale. Your divorce attorney should confirm who can sign the listing and the deed.

Should we list before the divorce is final?

That depends on the case. Some couples sell during the case; others wait for a settlement or judgment. Do not list until counsel confirms authority and how proceeds will be held.

How do we agree on a price?

A written broker opinion of value gives both sides the same starting point. An appraisal may be required by the court or by counsel.

Where do the sale proceeds go?

Often into escrow or a trust account until the divorce settlement allocates them. Your attorneys set that language in the contract.

What does AcreX charge?

The published sale fee: 5% up to $5M, 4% on $5M–$10M, 3% above $10M, $10,000 minimum. In New Jersey commissions are negotiable.
