What ‘distressed’ usually means
Loan default, acceleration or a lender demand
Vacancy that is draining cash
Deferred maintenance buyers will price into the offer
A court, estate or partnership deadline that forces a sale
How a sale still works
1. Get a written opinion of value that reflects vacancy, repairs and timeline — start with What is my commercial property worth?.
2. Tell your attorney and, if needed, the lender what you plan to do before you accept an offer.
3. Sign a written listing agreement (N.J.S.A. 25:1-16) that states the fee and term.
4. Market honestly: disclose known issues; serious buyers price risk, not surprises.
5. Compare offers on net proceeds, deposit, due diligence length and closing date — not only headline price.
6. Complete NJ seller filings (transfer fee, bulk sale, and nonresident withholding if they apply).
Documents buyers and lenders ask for
Deed, survey, leases and rent roll, expense history, tax bills, loan statements or payoff letters, inspection reports and any environmental reports. Industrial sites may trigger ISRA (NJDEP ISRA applicability).

Questions owners ask
What is a distressed commercial property sale in NJ?
Usually a sale where the owner faces loan default, deferred maintenance, vacancy or a tight timeline. Pricing and marketing still matter; buyers discount for risk and time.
Can AcreX list a property that is in default or pre-foreclosure?
Yes, if you have the legal right to sell it. Tell the broker about the loan status, any notices and your timeline so offers can be structured honestly.
Will buyers pay less for a distressed building?
Often yes, because of repair risk, vacancy, lease issues or a short closing window. A written opinion of value that reflects those facts helps you compare offers fairly.
Do New Jersey seller filings still apply?
Yes. Realty transfer fee, bulk-sale notice (Form C-9600) and, for nonresidents, estimated income tax withholding still apply unless an exemption fits. Confirm with your attorney.
What does AcreX charge on a distressed sale?
The same published sale fee: 5% up to $5M, 4% on $5M–$10M, 3% above $10M, $10,000 minimum. In New Jersey commissions are negotiable.
